This is an application for condonation of delay of 130 days caused in filing the present First Appeal.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate Mr. S. S. Rathi appearing for respondent no.2 strongly opposed the application and submitted that there is no sufficient reason to condone the delay.

On perusal of the application, particularly reasons stated in the application, it appears that applicant was facing some financial crisis and he required some time to collect money to proceed against the impugned judgment and award. From this, it is crystal clear that delay is not deliberately caused. Hence, following order:

Civil Application is allowed.

Delay of 130 days caused in filing the First Appeal is hereby condoned.
