This application is for condonation of delay of 1313 days in bringing LR's of deceased appellant No.3- Uttam Atmaram Dhengale on record. Notice is yet to be issued to the respondent in original appeal, however, caveator has appeared.

2. Perusal of the application shows that no malafides can be attributed to the applicants in bringing LR's of deceased themselves on record in time. In any case the deceased is one of the appellant. As such the merit of appeal would not have affected by his death. Hence, application is 908.sa.285.19.odt

allowed in terms of prayer clause 'A'. Amendment be carried out within a period of two weeks.
