Applicant apprehends arrest in connection with Crime No. 1340 of 2023 registered with Kotwali Police Station, District - Ahmednagar for offence punishable under sections 406, 420, 506 read with 34 of the Indian Penal Code.

FIR is lodged by Mansi Kaustubh Ghule, alleging that she gives private tuitions. She developed acquaintance with the accused persons, who run Leo Holidays Tours and Travels. They provoked and prevailed upon her and others to invest amounts in the said company, assuring that they would earn handsome returns on the investments. Accused persons, between 27th

{2} January, 2023 and 11th July, 2023, fraudulently procured an amount of Rs.83,61,000/- from informant and others. However, they neither paid any amount as agreed nor the principal amount. When the informant and others demanded their money back, they were threatened by the accused persons of dire consequences and thus defalcated their huge amounts. 3.

Heard learned advocate for applicant and learned APP for the State. Perused the investigation papers.

FIR is lodged on 3rd November, 2023. It is the case of the applicant that she is one of the investors, who is duped by accused persons. Applicant is carrying 7 months' pregnancy. She was granted interim protection and she has attended police station for four days and co-operated in the investigation. This fact is confirmed by the learned APP.

Considering the gender of the applicant and the fact that she is in her advanced stage of pregnancy and in view of the allegations made in the FIR and the role attributed to the applicant, applicant's custodial interrogation is not necessary, in the peculiar facts of the case.

Applicant is permanent resident of Ahmednagar and has deep roots in the society. If arrested, her image will be tarnished

{3} in the society. Hence, the applicant is entitled for protection. 7..

Anticipatory Bail application is allowed by confirming the interim protection.
