This application is filed for condonation of delay of 716 days caused in filing an appeal.

It is stated in the application that the applicant was not aware of the remedies available for filing an appeal. In the jail he came to know that an appeal can be filed even through the legal aid. It is thereafter, he communicated the same with the jail authorities. The jail authorities made correspondence

904appln4291.19 with the office of the Legal Services Authority, Sub Committee, High Court, Aurangabad. The Legal Authority, Sub Committee, appointed a lawyer through legal aid and instructed him to prepare an appeal to present in the High Court. In that process delay is caused.

For the reasons recorded in the application and since the application is by the convict suffering sentence, this Court is inclined to allow the application. Hence following order :

ORDER

a) The Application stands allowed.

b) Delay of 716 days stands condoned.

c) The Application stands disposed off.
