PER COURT:- 1.

Mr. Tekale, learned counsel for the petitioner submits that the petitioner has filed application before the Recovery Officer for refund of the amount deposited by the petitioner pursuant to the auction. The auction has been set aside by the Court. Part of the amount has remained to be paid to the petitioner.

It is for the Recovery Officer to consider the application filed by the petitioner on its own merits, after hearing all parties concerned.

The petitioner may request the Recovery Officer to decide the application expeditiously. The Recovery Officer shall consider the application

(2) 34-wp-2152-2020 filed by the petitioner for expeditious disposal of his application (Exhibit 329) and endeavour to decide the same expeditiously, after hearing all parties concerned, on its own merits.

In case, thereafter also, the application (Exhibit 329) is not decided expeditiously, then petitioner may approach this Court.

Writ Petition accordingly disposed of. No costs.
