DATE : February 14, 2022 Considering the nature of order proposed to be passed, it is not necessary to issue notice to respondent No.5. The only prayer made by the petitioner is to direct the respondent No.1-Director of Health, Health Services, Mumbai to take a decision on the petitioner's representation dated 04/10/2017. By this representation the petitioner seeks to point out his entitlement for appointment on a Class-IV post which appointment according to the petitioner has been made in favour of respondent No.5.

Considering the nature of relief sought, the respondent No.1 is directed to take a decision on the representation dated 04/10/2017 within a period of four weeks of production of this order before him. If the respondent No.1 finds it necessary to obtain the say of respondent No.5, notice in that regard shall be issued by the respondent No.1 to obtain the say of respondent No.5. The representation be decided on its own merits and in accordance with law.

Keeping all points raised open, the writ petition is disposed of with aforesaid directions. No costs.
