Heard the learned counsel for the applicant.

Learned counsel for the applicant has filed this application to transfer the marriage petition, which is pending before the Joint Civil Judge Senior Division, Kelapur, Yavatmal, filed by the non-applicant to the Civil Judge Senior Division, Chandrapur.

Learned counsel appearing for the applicant has stated that the applicant is staying at Ballarpur with her 10 months old daughter and Domestic Violence proceeding is pending before the Judicial Magistrate First Class, Ballarpur, the Senior Division Court is not there.

Learned counsel for the applicant has stated that the applicant cannot travel with her 10 months old baby to Kelapur, which is 132 Kms away from Chandrapur. Only one bus is there from Ballarpur to Kelapur. As the non-applicant has filed the divorce petition at Kelapur Court, she has prayed to transfer the matter, which is pending before the Joint Civil Judge Senior Division, Kelapur, Yavatmal to the Civil Judge Senior Division, Chandrapur. 5.

Though, the non-applicant is served, is not present before the Court.

As it is difficult for applicant to travel along with her 10 months daughter because only one bus is there from Ballarpur to Kelapur, the Hindu Marriage Petition bearing No.128/2023, filed by the non-applicant pending before the Civil Judge Senior Division, Kelapur is transferred to the file of Civil Judge Senior Division, Chandrapur.
