The learned counsel for the applicant informs that both the parties are personally present in the Court and they have been identified by the learned counsel for applicant.

He further points out that both the parties have amicably settled the matter and reduced the terms of compromise in writing. It is stated that, the learned trial Court is not taking such settlement on record and permitting to withdraw the proceedings on the ground that a stay is operating in this matter.

In the circumstances, the present application is disposed of. The stay is vacated and directed the learned trial Court to accept the settlement and pass the appropriate order as per law.
