After hearing learned counsel for the applicant to some extent and after going through the investigation papers, I have shown my disinclination to grant bail. Learned counsel for the applicant seeks permission to withdraw the application with liberty to file, if the trial is not concluded within three months.

The accused is facing charge under Section 302 of the Indian Penal Code, 1860, considering the investigation papers, it will not be appropriate to conclude the trial within three months. The applicant is at liberty to file fresh application, if there is no substantial progress in the trial within six months.

The learned trial Court shall consider the application of the applicant, at the time of separation of the trial.
