The office note shows that report of execution of non-bailable warrant issued to secure the presence of appellant is awaited. However, as per the communication from Police Sub-Inspector, A.C.B., Buldhana to the office of Public Prosecutor, the appellant is reported to be dead on 6th August, 2008.
On 28th June, 2017, the learned Advocate, who represented the appellant, stated that she will seek instructions from the legal representatives of the deceased appellant on the point whether they intend to continue the prosecution of the appeal.
Shri R.M. Daga, Advocate states that he has not received any instructions.
Considering the above facts, appeal is disposed of as abated.
