The learned Trial Court convicted the respondent of the offence punishable under Section 498-A, Indian Penal Code, however, acquitted him of the offence punishable under Section 306 of Indian Penal Code.

In spite of service, the respondent has not put appearance. Hence the application is allowed. Leave is granted to the applicant, especially in view of findings recorded by the Trial Court in para 28 of the impugned Judgment.
