The petitioners have approached this Court with a prayer for declaration that the construction of dumping yard for solid waste management center being constructed on Gat No.205/2 area 0.98 H. R. of Mouza-Kalamna, Tah. Mohadi, DistrictBhandara is without any sanction and thus the same is illegal and causing hardship to the petitioners and other farmers. 3.

Our attention is invited to the objection dated 11/12/2025 (Annexure-16 page 108 of the petition) raised by the petitioners and other villagers and submitted to the Collector, Bhandara pointing out the aforesaid illegality. 4.

Shri K. S. Motwani, learned counsel for the petitioners makes a statement that aforesaid objection has not yet been decided by the Collector, Bhandara.

In view of aforesaid, the petition can be disposed of by passing the following order :

(i) Respondent No.3-Collector Bhandara is directed to decide the objection dated 11/12/2025 raised by the petitioners and other villagers (Annexure-16 page 108

2 104-WP-77-26.odt of the petition) within a period of two weeks from the date of appearance of the petitioners and production of copy of the order passed by this Court before him. (ii) The petitioners to appear before respondent No.3Collector, Bhandara for hearing on 08/01/2026 with the copy of this order.

(iii) The respondent No.3-Collector, Bhandara is directed to consider the objection of the petitioners so also the grounds raised in the present petition while taking decision upon the same in accordance with law. (iv) The decision taken by the Collector, Bhandara within a period of two weeks from 08/01/2026 shall be communicated to the petitioners within a period of two weeks thereafter.

With the aforesaid directions, writ petition is disposed of. No costs.
