Admittedly, the complainant-Shivani belongs to Scheduled Caste and is a minor. The offence is under Section 376 (d) of IPC and Section 4 of the POCSO Act. Perused the FIR. The FIR clearly shows that the applicant sexually exploited her repeatedly and when the complainant could not tolerate his robust behaviour, the complainant attempted to commit suicide. It is, in this context, the police recorded the statements. There is, thus, clear evidence against the applicant, who is directly involved in the commission of offence.

In view of above, I make the following order.

ORDER

(i) Criminal Application No.1/2016 is rejected.
