The applicant has filed the present Application under Section 439 of the Code of Criminal Procedure, seeking bail for the offence punishable under Sections 376(1), 376(2)(n) and 506 of the Indian Penal Code, in respect of Crime No. 247/2020 registered at Police Station Tamgaon, Dist. Buldana.

The prosecutrix, a married lady, aged about 30 years, is having two children. The allegations against the applicant are that on the promise of marriage, the applicant established sexual relationship with her. When the husband of the prosecutrix came to know about the said relationship, the complaint came to be lodged. The applicant was granted interim bail by this Court (Pushpa Ganediwala, J.) on 9.1.2021.

As of today, there are no complaints against the applicant that he has misused the liberty granted by this Court.

Considering the manner in which the incident had taken place and also the fact that now the charge-sheet has been filed, the applicant is entitled for grant of bail. Hence the order:-

ORDER

The interim order of bail granted by this Court on 09.01.2021 is hereby confirmed, on the same terms and conditions enumerated therein. The Application stands disposed of. APPP: 35/2021 In view of the disposal of the main application, this Application does not survive. The same is disposed of.
