DATE : October 09, 2018 Prayer is to condone delay of 33 days in filing the Second Appeal. Reasons for the cause of delay are mentioned in paragraph 3 of the application.

The learned counsel for the non-applicant initially sought time to file reply to oppose the application for condonation of delay. Without prejudice it is submitted that reasons mentioned are not sufficient.

Considering the short period of delay of 33 days coupled with the explanation given in paragraph 3 which appears to be acceptable, delay in filing the Second Appeal stands condoned.
