This application is filed by the applicant for restoration of appeal.

As per the contention of the applicant, due to the non-deposit of the Court fees within a period of twelve weeks, the appeal was dismissed at its registration stage. 3.

Inadvertently, the order passed by this Court is not noted by the learned counsel and therefore, the compliance was not made.

Mr P.A. Mehta, learned counsel for the non-applicant No.1 objected for the same.

5.

The appellant has already deposited the amount of the Court fee. In view of that, the appeal be restored on its original stage of registration.

Misc. Civil Application is disposed of.
