The present application is filed for transfer of pending proceeding of H.M.P. No.14/2022 on the file of learned Civil Judge, Senior Division, Umrer, District Nagpur to file of learned Civil Judge, Senior Division, Chandrapur. It is contention of the applicant that marriage between the applicant and non-applicant was solemnized on 22.03.2014. The applicant is suffering from 81% disability of hearing impairment. Due to ill-treatment and torture, she has driven out by the non-applicant in the year 2018. The distance between Umrer to Chandrapur is 148 kms. Considering that she is suffering from 81% hearing disability and distance, it could not be convenient for her to attend the matter at Umrer. So far as reply filed

2 928 mca 07-2023 by the non-applicant, he is having one short leg, however, it does not hamper routine work. The certificate is placed on record along with reply. 3.

However due to her disability of 81%, there is more inconvenience to the applicant to travel Umrer and attend the proceeding at Umrer. So far as respondent is concerned, he can be permitted to appear through video conferencing. As such, the application is allowed. Accordingly, I proceed to pass the following order:

ORDER

i) The application is allowed.

ii) The proceeding bearing H.M.P. No.14/2022 from file of learned Civil Judge, Senior Division, Umrer is hereby withdrawn and transferred to the file of learned Civil Judge, Senior Division, Chandrapur. iii) Learned Principle Judge, Umrer, is hereby requested to facilitate the transfer.

iv) The non-applicant is permitted to appear through video conferencing before the Chandrapur Court, unless his presence is required by the Court itself.

The Application is disposed of accordingly.
