Shri Samudra, the learned Counsel appearing for the respondent/contemnor makes a statement that, according to the respondent, the total amount due and payable to the petitioner in terms of the decision of this Court rendered on 8th of January, 2015 in Cross Objection No.60/2013 in First Appeal No.167/1989 comes to Rs.7,89,720/-, which is inclusive of interest calculated up to 4th of January, 2016. The calculations of the amount payable and the interest payable thereon has been disputed by the learned Counsel for the petitioner. The learned Counsel for the petitioner submits that he shall file proper calculations on record and for that purpose he seeks time in the matter.

cp.311.15 2/2 The contemnor to deposit the entire amount of Rs.7,89,720/- in this Court within a period of two days from today. This Court is not going into the correctness of the calculations made by the respondent and the question is left open to be decided by the Executing Court. The appellant is at liberty to file the execution proceedings as per the decree passed by this Court in the first appeal arising out of the reference proceedings under Section 14(2) of the Coal Bearing Areas (Acquisition and Development) Act, 1957. The statement made by the learned Counsel appearing for the respondent is accepted.

Put up this matter on Friday, the 8th of January, 2016 to see the compliance.

Civil Application No.1/2016 :

Shri Samudra, the learned Counsel appearing for the applicant-respondent submits that the respondent is personally present before this Court.

Hence, his presence is marked. It shall not be necessary for the respondent to appear before this Court in person until further orders.
