After hearing this matter for some time, learned counsel for the applicant, on instructions, seeks leave of the Court to withdraw the application with liberty to file a fresh bail application, if the trial of the case against the applicant is not over within six months from the date of the order. He also seeks direction of this Court for expeditious disposal of the sessions case.
Leave with liberty as prayed for is granted. The trial Court is directed to expeditiously decide the sessions case in accordance with law and in any case within six months from the date of the order. If the trial is not concluded within six months from the date of the order, the applicant shall have liberty to file fresh bail application on the ground of non-conclusion of trial within the stipulated period of time before the same sessions Court and if such an application is filed, it shall be decided by that Court in accordance with law without being influenced by the orders passed by this Court.
