After arguing for some time it was noticed that the applicant has not made any averment in the application about criminal antecedents which according to me is one of the relevant factor while considering the application under Section 438 of the Criminal Procedure Code.
The learned Advocate for the applicant seeks permission to withdraw application with liberty to file fresh application. The application is dismissed as withdrawn with liberty to file fresh application, if so advised. The interim protection granted by this Court by the order dated 30th March, 2016 shall continue to operate till 20th June, 2017.
