This is an appeal preferred by the original complainant challenging the judgment and order of acquittal of the respondent Nos.1 to 3 dated 31/07/1999 passed by J.M.F.C., Kelapur acquitting respondent Nos.1 to 3 of the offences punishable under Sections 452, 323 and 379 read with Section 34 of Indian Penal Code.

Learned counsel for respondent Nos.1 to 3 produced copy of the death certificate showing that appellant Smt.Shailabai W/o Moreshwar Darwarkar has died on 31/07/2013. Copy of the said death certificate is taken on record and marked as 'X' for identification.

In view of death of the appellant, the matter stands abated and accordingly disposed of.
