None appeared for the appellant on 1st April, 2015. This Court directed issuance of notice to the appellant. The appeal was listed on 16th June, 2015 on which date again there was no appearance on behalf of the appellant. Today also none appears for the appellant.

Shri S.M. Bhagde, learned A.P.P. has pointed out the report dated 27th March, 2015 submitted by the learned Assistant Sessions Judge to the effect that though this Court had directed the release of the appellant on bail, the appellant had not submitted the surety and was in jail till 25th August, 2009 when he is released after he has undergone the sentence as per the judgment given in Sessions Trial No. 192 of 1995 on 29th October, 2001. The above judgment is challenged in this appeal.

In view of the above facts, in my view, nothing survives in the appeal. It is disposed of accordingly. JUDGE RRaut..
