13/01/ Learned counsel for the appellant states that in view of the judgment of this Court in Vitthal Ramchandra Mali and others Vs. Laxmi Ganpati Mali and another reported in AIR 2006 Bombay 298, the appeal against the impugned judgment and order will lie to the District Court, Nagpur.

Learned Counsel for the respondent nos. 4 and 5 have also filed pursis in this appeal stating that the respondent nos.4 and 5 have also filed an appeal against the same judgment being First Appeal Stamp No.16155/2021 along with Delay Condonation Application No.16156/2021. He submits that the said appeal along with delay condonation application will also lie before the District Court, Nagpur.

2 52 fa 192-2020 The First Appeal No.192/2020 along with memorandum of appeal as well as in First Appeal Stamp No.16155/2021 with Delay Condonation Application No.16156/2021 along with accompaniment be returned to the concerned Advocates appearing for the appellants in respective appeals for presentation to appropriate Court. The office will also return all pending Civil Applications along with memorandum of first appeal.
