Heard.

Mrs. M.A. Khare, learned counsel for the applicant, has filed Pursis informing that the Demand Draft in the sum of Rs.1,25,072/- is already furnished to the Corporation. Shri J.B. Kasat, learned counsel also accepts this.

During hearing Shri J.B. Kasat, learned counsel, submits that amount of Rs.1,55,000/-, appearing in order of this Court dated 17.6.2014 .....2/-

mca95.15 in Civil Application (CAW) No.1441 of 2014, is incorrect and it ought to have been Rs.1,25,072/-.

In view joint statement made, we accept the same. It, therefore, appears that order of this Court dated 17.6.2014 is complied with.

Prayer in Misc. Civil Application is to recall of order dated 25.11.2014 and restore writ petition back to file.

The application is supported by the personal affidavit of the learned counsel. We do not see any reason to disbelieve it.

As such, the Misc. Civil Application is allowed. Order dated 25.11.2014 is recalled and Writ Petition No.437 of 2000 is restored to file.

Shri J.B. Kasat, learned counsel, waives notice in writ petition after restoration.
