The registration of appeal was refused by the Registrar (J) for not removing office objection within the stipulated time.

The counsel for applicant states that she missed to note the date before the Registrar's court and therefore, could not take cognizance of the order.

Later on she came to know of the impugned order, and therefore, has immediately filed application to restore the appeal along with the application for condonation of delay of 80 days.

Experience shows that the Advocates do not take Registrar's court seriously. This fact has been proved by the submissions made by the counsel that the case and date

In the circumstances, but considering the involvement of rights of the applicant in filing second appeal, the application is allowed subject to costs of Rs.1000/- to be deposited with the High Court Bar Library, Nagpur within two weeks from today, failing which the application shall stand dismissed without further reference to this Court. If the amount is deposited, the appeal shall stand restored on the file and the applicant shall remove the office objections within one week thereafter, registration of appeal shall stand refused without reference to the court. 5.
