Record shows that on three last dates, the Applicant and his Counsel were not remained present before this Court. Hence ultimately on 19.07.2021, this Court (Coram : Pushpa V. Ganediwala, J.) ordered that the Misc. Civil Application be placed for dismissal. 2.

Today, when the Application was listed, the learned Counsel Shri. O. W. Gupta for the Applicant is absent. It shows that the Counsel for Applicant is not interested in prosecuting the matter. Hence, the Application is dismissed for want of prosecution. 3.

It is made clear that if the Counsel for Applicant is moving the Application for restoration, the Registry is directed not to accept the same unless costs of Rs.5,000/- are deposited with the High Court Legal Services Sub Committee at Nagpur.
