The application seeking restoration of Writ Petition No. 5659/2015 is within time. It appears that Writ Petition was listed for the first time on 03.12.2015, and the learned Counsel for the applicant states that it was called out when he was on his legs before other Court. Before he could reach the Court, the matter came to be dismissed in default.

In Writ Petition challenge is to dismissal on account of his conviction after departmental enquiry.

As we do not see any malafides, the order dated 03.12.2015 is therefore, recalled and Writ Petition is restored back to file.
