Heard Mr.Daga, learned counsel for the applicant and Mr.Rode, learned Additional Public Prosecutor for non applicant-State. Also perused the reply filed on behalf of the prosecuting agency as well as charge-sheet.

Applicant is arrested on 11.06.2019 in connection with Crime No.125/2019 registered with Police Station, Dhamangaon, Buldhana for an offence punishable under Sections 304(B), 306, 498A read with Section 34 of the Indian Penal Code.

Deceased is the wife of the applicant. According to the prosecution case she committed suicide due to illtreatment received by her at the hands of applicant and his other family members. From the prosecution case it is clear that on the day of the incident it is the applicant who went to the house of the complainant Ananda Malekar to fetch deceased to her matrimonial house and in the evening Ananda received a phone call from the applicant that deceased is suffering from dizziness and froth is coming out of her mouth.

This Court (Coram: Manish Pitale, J.) on

ba12.20.odt 30.07.2019 has released the in-laws of the deceased on regular bail with a condition that they shall attend the police station once in a week.

Report is dated 11.06.2019 lodged by Ananda shows that there are no specific allegations against the applicant about the demand. The allegations about demand and ill-treatment to deceased are against all the co-accused persons.

In that view of the matter and when the chargesheet is filed and co-accused are released on bail, the applicant can also be released on bail. Consequently, I pass the following order:

ORDER

(i) The application is allowed.

(ii) Applicant-Ishwar s/o Dayaram Ravekar be released on bail in connection with Crime No.125/2019 registered with Police Station, Dhamangaon, Buldhana for an offence punishable under Sections 304(B), 306, 498A read with Section 34 of the Indian Penal Code, on he executing P.R. bond in the sum of 25,000/- with one ₹ solvent surety in the like amount.

(iii) Applicant is directed to attend Police Station, Police Station, Dhamangaon, Buldhana twice in month i.e. on third Saturday and last Sunday every month and shall be with the investigating officer from 03:00 p.m. to 05:00 p.m., until culmination of the trial.

The application is disposed of.
