DATE : 20/01/2023 1] Since the petition challenges an interim order dated 16.12.2022 in appeal which is still pending before the Respondent No.1, which an appeal under Section 39(3) of the Maharashtra Village Panchayat Act, it would be appropriate if the appeal is directed to be decided.

2] None appears for Respondent Nos. 3 to 9 though served.

3] Learned AGP for Respondent Nos.1 and 2 has no objection for such a course of action, considering which the petition is disposed of by directing Respondent No.1 to decide the appeal within a period of 3 months from 30.1.2023.

(2) 924wp143.23 4] The Learned counsel for the petitioner shall place a copy of this order before the Respondent NO.1 on 30.1.2023 in order to apprise him of the same. 5] A copy of this order shall also be e-mailed to all the Respondent Nos. 3 to 9 by the petitioner. 6] On 30.1.2023, the Respondent No.1 shall fix a date for appearance and shall proceed with the matter ahead.
