By this Family Court Appeal, the appellant-husband has challenged the judgment of the Family Court, Nagpur allowing the petition filed by the respondent-wife for restitution of conjugal rights and directing the appellant to pay a sum of Rs.1,000/- per month to the respondent towards maintenance from the date of the petition.

Since the learned Counsel for the appellant was elevated as an Honourable Judge of this Court, this Court, issued notice to the appellant for engagement of another counsel. The notice is duly served on the appellant on 05.05.2014. Despite the service of notice for engagement of another counsel on the appellant, the appellant has neither engaged a counsel nor is the appellant prosecuting the matter. It appears that the appellant is not interested in prosecuting the matter as the decree is for restitution of conjugal rights and the appellant was directed to pay only a sum of Rs.1,000/- per month to the respondent towards maintenance.

Hence, the Family Court Appeal is dismissed for want of prosecution.
