Shri Kadu, learned counsel for the petitioner states that IRB Talegaon, Amravati, which is managing Toll Plaza at Mouza - Devgaon, is essential party. Shri Kalangiwale, learned counsel appearing for respondent No. 3 does not dispute this, however, he seeks discharge of Respondent No. 3. According to him, existing Respondent No. 3 is not necessary party. The said contention is kept open.
Subject to this, Civil Application is allowed. The necessary amendment be carried out within three days. Issue notice to added respondent, returnable on 20.07.2015.
Shri Kalangiwale, learned counsel waives notice for the added respondent.
