This is an application for condonation of delay of 827 days in filing the appeal on the premise that the in the letter received from the legal officer the name of panel advocate was not mentioned and therefore, the matter was remained to be allotted and when the matter sent back to the legal officer, it is informed that the matter is allotted to the present counsel and again there was no communication from the MSRTC therefore appeal could not be filed within time. 2.

Application is opposed on the ground that huge delay of 827 days has been caused and sought rejection of the application.

No doubt there is considerable delay in filing the present appeal. However, considering the reasons mentioned in the application and the fact there is no malafide on the part of the appellant to cause the delay, in my view, the

26 caf181.25.odt delay can be condoned subject to payment of costs. Hence, delay in filing the appeal is condoned subject to payment of costs of 10,000/- to the District Bar Association, Gondia, ₹ within two weeks.

Appeal be registered upon placing on record a copy of receipt of payment of costs.

The application stands disposed of.
