Heard Advocate D.T. Patil for the petitioner and Mrs. Kalayani Deshpande, learned AGP for respondent no. 2 and 3. 2.

Caste claim of the petitioner as belonging to Rajput Bhamta, N.T., is still pending. This Court has on 12.1.2015 protected his employment and no coercive steps in furtherance of the order dated 12.11.2014 have been taken.

The petitioner has joined employment on 19.5.1999, i.e. prior to delivery of judgment by the Constitution Bench of Hon'ble Apex Court in State of Maharashtra vs. Milind Katware reported in 2001(1) SCC 4. In this situation, we direct the petitioner to appear before respondent no. 2 Committee on 25.5.2015 and to abide by its further instructions in the matter. The Committee shall attempt to

0704wp101.15 complete the enquiry in accordance with law in next one year. The interim order passed by this Court to continue and shall be subject to further orders of scrutiny committee in this regard. 4.

Arguments of Mr.Patil regarding grant of protection in employment are kept open and shall be considered thereafter, if occasion therefor arises. Petition is partly allowed. No costs. Judge Judge /TA/
