DATE : March 27, 2019 The petitioners who are the original plaintiffs besides challenging the order passed by the trial Court below Exhibit-74 permitting the defendant to lead his evidence are also seeking expeditious disposal of the suit for eviction as filed by them. This Court on 11/01/2019 passed an interim order by virtue of which the said defendant was permitted to examine himself and was thereafter cross-examined by the plaintiff. Considering the said interim order it is not found necessary to now adjudicate upon the correctness of the order passed below Exhibit-74. The interests of justice would be made if the suit in question is directed to be disposed of expeditiously.

Accordingly, the trial Court is directed to decide R.C.S.No.84 of 2013 on its own merits and in accordance with law by the end of June 2019.

With these directions the writ petition is disposed of with no order as to costs.
