The applicant is arrested on the allegation that he is involved in the crime for the offences punishable under Sections 364, 302 and 201 read with Section 34 of the Indian Penal Code. According to the prosecution, the deceased was lastly seen along with the applicant. The case of prosecution is that Raju Babarao Urwate (co-accused) believed that his mother died due to black magic played by the deceased and the applicant supported Raju Babarao Urwate in committing the offence. Raju Babarao Urwate is granted bail by this

The applicant is a Labourer. It is undisputed that there is no record of involvement of applicant in any other crime, earlier. The applicant is married and is having two daughters and his parents are also living with him.
The charge-sheet has been filed. The non-applicant has not been able to show that custody of applicant is required for further investigation.
In the above facts, I am of the view that the applicant is entitled for bail.
Hence the following order:
(i) The applicant having been arrested in Crime No.37/2015 registered by the non-applicant be released on bail, on furnishing P.R. bond for Rs.10,000/- and one solvent surety in the like amount. (ii) The applicant shall attend the Sessions Court regularly on each date unless granted exemption by the Sessions Court. In case of default on the part of the applicant to attend any date of Sessions Court without seeking exemption from the Sessions Court, this order shall stand recalled.
(iii) The application is allowed accordingly.
