DATED : 29/01/2019 The learned advocate for the applicant, on instructions, submitted that if the issues raised in this application are kept open and the applicant is granted exemption from appearing before the trial Court on regular dates, the applicant seeks permission to withdraw the criminal application.

The learned advocate for the non-applicant no. 1 - complainant has no objection for disposing the application as per the prayer made on behalf of the applicant. The criminal application is disposed as withdrawn. In the circumstances, the parties to bear their own costs.

The learned Magistrate shall not insist for appearance of the applicant on regular dates.

2 apl4.18 The applicant undertakes to appear before the trial Court as and when ordered/directed by the learned Magistrate.
