Heard learned counsel Shri A.D. Bhate for the applicant and learned Additional Public Prosecutor Shri V.A. Thakare for the State so also perused the reply. 2.

The applicant is apprehending her arrest in connection with Crime No.282/2017 registered with Shegaon Rural Police Station , District Buldhana for the offences punishable under Sections 323, 354, 354-B, and 504 read with Section 34 of the Indian Penal Code and Section 3(1)(w)(i)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. 3.

It is clear from the reply that the dispute between the complainant and the husband of the present applicant arose since the husband of the present applicant was restrained from entering into the field of the complainant. On this issue, the dispute arose in .....2/-

between them. The role attributed to the applicant is that subsequently she pulled hairs of the complainant. Except this, there are no allegations against the present applicant. 4.

The reply states that main accused, that is the husband of the applicant, was arrested and is released on bail. 5.

In that view of the matter, I see no reason to deny the relief of anticipatory bail in favour of the applicant. Consequently, I pass the following order:

ORDER

(i) The criminal application is allowed.

(ii) Applicant Sau. Nandabai w/o Nandu Ghorale be released on bail on she executing a P.R. Bond in the sum of Rs.25,000/- with two solvent sureties of the like amount, in the event of her arrest in connection with Crime No.282/2017 registered with Shegaon Rural Police Station , District Buldhana for the offences punishable under Sections 323, 354, 354-B, and 504 read with Section 34 of the Indian Penal Code and Section 3(1)(w)(i)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

(iii) Needless to state that the observations made in this order are purely for deciding the application for grant of bail only and learned Judge of the Court below, who shall be trying the Case, shall not get .....3/-

influenced by the observations made in this order. (iv) With this, the criminal application is allowed and disposed of.
