This is an application for grant of bail by the sole appellant - Suresh Mahadeo Deshmukh.

Heard learned counsel for rival parties. We have perused the evidence with the assistance of the learned counsel for the rival parties, so also the reasons recorded

by the Trial Judge for convicting the applicant-appellant. We find that the case is based only on the circumstantial evidence and conviction was recorded by the learned Trial Judge on the evidence which was contradictory.

Prima facie, we are satisfied, looking to the fact that there are minor children in the house of applicant who are required to be looked after, the applicant should be released on bail. Hence the following order:-

O R D E R

[a] Criminal Application No. 9 of 2015 is disposed of.

[b] Applicant shall be released on bail upon furnishing a Personal Bond in a sum of Rs.

10,000/- [rupees ten thousand only only] with one surety in the like amount, pending decision of instant appeal.

[c] Fees payable to learned Adv. [appointed] for the applicant are quantified at Rs.150000 [rupees one thousand five hundred only].
