The Order Below Exhibit 11 dated 13th October, 2023 passed by learned Joint Civil Judge, Senior Division, Chandrapur in H.M.P No. 386 of 2022, granting ad-interim maintenance to the respondent to the tune of Rs.15,000/- per month, is under challenge in this writ petition.

It is the case of the petitioner that though his income is in between Rs.45,000/- to Rs.50,000/-, however, there are deductions of loan of Rs.14,000/- SKNair

7-wp-162-24.odt towards the vehicle loan, Rs.4,000/- as Income Tax and Rs.15,000/- towards the PPF deductions.

The amount deducting towards the loan i.e.

vehicle loan cannot be considered for determining the amount of maintenance and as far as the deduction towards PPF is concerned, the said amount can be varied.

In that view of the matter, I am of the view that no error has been committed by the learned joint Civil Judge, Senior Division, Chandrapur in granting Rs.15,000/- towards the interim maintenance to the non-applicant. Accordingly, the writ petition is dismissed.

Learned counsel for the petitioner prays to expedit the proceeding.

Considering the fact that it is the matrimonial matter and pending since 2022, the learned Joint Civil Judge, Senior Division, Chandrapur is directed to expedite the proceeding and decide the same within one year from the next fixed date.

The petitioner undertakes to cooperate the learned trial Court to decide the matter within a stipulated period.
