IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

NAGPUR BENCH : NAGPUR.

CONTEMPT PETITION NO. 47/2020 IN WRIT PETITION NO.3768/2018(D) Shaila Anjum d/o Mohd. Rafique and others.

Vs.

Ambadas S.Pendor (Now Shiv Ling Patwe),Deputy Director of Education, Amravati Division, Amravati and others.

------------------------------------------------------------------------------------------------ Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order ------------------------------------------------------------------------------------------------------------------------------ Shri M.R.Joharapurkar, Advocate for petitioners. Mrs. S.S.Jachak, Assistant Government Pleader for respondents. CORAM :- A.S.CHANDURKAR AND G.A.SANAP, JJ.

DATED :- DECEMBER 07, 2021.

The grievance of the petitioner no.1 is that the directions issued in Writ Petition No.3768/2018 dated 20.09.2019 by which the Deputy Director of Education, Amravati Division, Amravati and Education Officer (Secondary), Zilla Parishad, Yavatmal were directed to process the salary bills of the petitioner no.1 and release the same accordingly have not been complied with.

After the notice was issued in the contempt petition, an affidavit has been filed on behalf of the respondent no. 2 in which it has been stated that the arrears of salary from 01.02.2017 to 24.12.2019 have been released in favour of the petitioner no.1. The petitioner no.1 has received the same on 07.07.2021 and has also acknowledged the same under her signature. In the said receipt, the petitioner no.1 has stated that she has no grievance in that regard. It is further seen from the affidavit filed by the respondent no.2 that the approval for the post of 'Head Mistress' that was granted to the petitioner no.1 has been cancelled from 25.12.2019.

7.CP47.20.odt 2 11.08.2021. The learned counsel for the petitioners submits that this order would be challenged by the petitioner no.1 before the appropriate forum.

We have perused the prayers that were made in Writ Petition No. 3768/2018. The main relief sought in the writ petition was a direction for releasing the salary of the petitioner no.1 from 01.02.2017. It is found that by releasing the salary of the petitioner no.1 from 01.02.2017 to 24.12.2019, the directions issued in the writ petition have been complied with. If, according to the petitioner no.1, she is entitled for any further relief despite issuance of receipt by her on 07.07.2021 that she had no grievance in that regard, it is open for the petitioner no.1 to seek redressal of such grievance in appropriate proceedings.

The contempt petition is disposed of.
