Heard Shri N.G. Moharir, learned Counsel for the applicant and Shri I.J. Damle, learned A.G.P. for respondent No.2.

The learned A.G.P. has no objection to this application.

When this matter was called for first time today, short time was sought on behalf of respondent No.1 by making a request for passing over of the matter. It was granted. Now, when this matter has been called out on the second occasion, no one appears on behalf of respondent No.1. No reply has been filed to this application by respondent No.1. In the circumstances, I am of the view that this application deserves to be allowed and more so for the reasons stated in the application. The application is, therefore, allowed.

caf.478.15 2 Leave to continue the proceedings in the name of Bakaram Karemore under Order I Rules 10 and 22 read with Section 151 of the Code of Civil Procedure is granted. Necessary amendment be carried out in the cause titles of delay condonation application, stay application and the appeal, being sought to be filed, within two weeks from the date of the order.

Put up after three weeks.

The application is disposed of accordingly.
