This application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks quashing of First Information Report (FIR) at CR No. 35/2023 registered with City Kotwali Police Station, Akola under Section 498A, 323, 504, 506 and 34 of the Indian Penal Code r/w. Section 4 of the Dowry Prohibition Act, which has culminated into proceedings bearing RCC no. 1037/2023 which is pending in the Court of learned Judicial Magistrate First Class, Akola. Non-applicant no. 2 has lodged the FIR in question. 3.

The matter arises out of matrimonial dispute. Applicant no. 1- husband and non-applicant no. 2- wife have amicably settled their dispute and affidavit to that effect is filed by non-applicant no. 2. She was present in the Court on 07.01.2025 and was identified by her advocate. She RR Jaiswal

2 7-apl-8-25.odt confirmed the settlement of matrimonial dispute and stated that she has no-objection if the FIR and proceedings are quashed.

Today, applicant no. 1 is present through Video Conferencing. He also confirms the fact of settlement of matrimonial dispute.

In view of the amicable settlement of the dispute between the parties and no objection of nonapplicant no. 2- informant, the application is allowed in terms of prayer-clause no. (i).
