Despite the learned Counsel for the petitioner admitting that there is an alternate remedy available to the petitioner, he has filed the present writ petition bypassing the alternate remedy. The justification for filing the writ petition avoiding the alternate remedy is that the order of the Collector is arbitrary. Such justification, for the reason for filing the writ petition and not availing the alternate remedy, cannot be accepted. Accordingly, the writ petition is dismissed. The liberty is granted to avail alternate remedy as available under the law.
