Though the explanation given in the Criminal Application is not satisfactory for the absence of the learned Advocate for the applicants on two occasions i.e. on 09.12.2020 and 16.12.2020, in our view, interests of justice would be subserved by passing the following order.: The order passed on 16.12.2020 is recalled, however on condition that the learned Advocate for the applicants shall deposit Rs.3,000/- (Rs. Three Thousand Only) with the High Court Legal Services Sub Committee, Nagpur and produce the receipt of it on record of this Criminal Application till 23.02.2021.

The Criminal Application (APPP) No.38/2021 is allowed in the above terms.

If the receipt showing deposit of amount of

24.Cri.APPP No.38.21 Rs.3,000/- (Rs. Three Thousand Only) as per this order is produced on record till 23.02.2021, list the criminal application (APL) No.256/2020 for consideration/hearing on 26.02.2021.
