This petition takes exception to the order dated 13.12.2023 passed by the learned Civil Judge Senior Division, Gadchiroli below Exh. 174 in Special Civil Suit No.17/2019.

By the order impugned, the learned trial Court has recalled the order of closing the evidence of respondent/defendant No.10 and permitted him to adduce evidence. After passing of the impugned order as the evidence was not lead, again the evidence was closed. However, again by subsequent order, the trial Court permitted the respondent/defendant No.10 to adduce evidence. Prity

The learned counsel for the respondent submits that pursuant to the subsequent order, respondent/defendant No.10 has filed the affidavit of examination-in-chief.
