Shri P.R. Agrawal, the learned Advocate, waives service of notices on behalf of the respondent Nos.1 to 3. Civil Application (CAF)( No.170 of 2014.

The appellant has deposited the amount as per the Award, before the Motor Accident Claims Tribunal, Wardha. The Chairman, Motor Accident Claims Tribunal shall disburse and deposit 50% of the amount deposited by the appellant to the claimants proportionately as per the impugned Award. The balance 50% of the amount shall be invested in fixed deposit in a Nationalised Bank initially for the period of three years and it shall be

2 fa51.14 renewed every year till the decision of the appeal. The award shall not be executed against the appellant. The claimants are at liberty, if so advised, to execute the award for the recovery of the balance 50% amount against the respondent Nos. 4 and 5.

The civil application is disposed in the above terms.
