The learned Counsel for the petitioners submitted that earlier the Arbitration Appeal which was pending before this Court was allowed on 30.05.2024, which order was challenged before the Hon'ble Apex Court by the respondents in Special Leave to Appeal (C) 14085/2025. The Hon'ble Apex Court while disposing of the S.LP. Has appointed Justice B. P. Dharmadhikari as a sole Arbitrator.

In view of the order passed by the Hon'ble Apex Court, the Trial Court has referred the Special Civil Suit No.393/2021 to the learned Arbitrator.

In view of all these three orders, the learned Counsel for the petitioners submit that the petitions have become infructuous.

The petitions stand disposed of as infructuous. No costs.
