After hearing learned counsel for parties, after considering circumstances against the applicant, and when the Court expressed its opinion that the Court is rejecting the application, learned counsel Shri A.M.Quazi for the applicant submitted that he has instructions to withdraw the application.

The criminal application is rejected as withdrawn.

Since learned counsel for the applicant is withdrawing the application, the Court is not giving detailed reasons for rejection of the application.

The applicant is in jail. He is tried for offence .....2/-

ba18.20 16 punishable under Section 302 of the Indian Penal Code. Learned Additional Sessions Judge, Bhandara, before whom Sessions Trial is pending, shall decide the same as expeditiously as possible and preferably within a period of one year from today.
