DATE : 9.3.2016 Heard Shri S.P. Chintakuntalwar, advocate for the applicant and Shri S.S. Doifode, A.P.P. for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Section 188, 468, 471 and 34 of the Indian Penal Code. The accusations against the applicant are that he is indulging in gambling and betting in cricket matches and for the purposes of his activities he has purchased sim card in the name of Rupesh Prajapati. The applicant contends that he has no concern with Rupesh Prajapati. Considering the nature of accusations and the nature of crime and the fact that the non-applicant has not been able to show that the
2 aba10.16 custody of applicant is required for further investigation, the following order is passed:
(i) In the event of arrest of applicant in Crime No.323/2015 registered by the non-applicant, he be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand Only) and one solvent surety in the like amount.
(ii) The applicant shall attend the police station Wadgaon Road, Yavatmal daily from 4 p.m. till 11 p.m. In the event of any single default on the part of the applicant to attend the police station, this order shall stand recalled. This condition shall be in force till 25th April, 2016.
(iii) The applicant shall deposit his passport with the Investigating Officer within three days.
(iv) The application is allowed in the above terms. JUDGE Tambaskar.
