On the request of Ms.Sunita Kulkarni, learned counsel h/f Shri Mahesh Rai, learned counsel for the applicant, matter was kept back. In the post lunch session, Ms.Sonali Khobragade, learned counsel h/f Shri Mahesh Rai is present and seeks accommodation.

Learned counsel for respondent No.2 strongly opposed for the same by referring to the order dated 09/09/2019 vide which on considering the subject matter in the application, time by way of last chance was granted to applicant to make statement whether to press this application or to withdraw the same. In spite of same, neither the

20APPP 18.19 counsel for the applicant is present before the Court in spite of keeping back the matter nor has issued instructions to make statement.

In that view of the matter and having considering the subject matter and also considering earlier order dated 09/09/2019, we do not find any substance for grant of further time as it is found that the applicant is not interested in prosecuting the claim. The application is accordingly disposed of as dismissed.
